APPLICANT REQUESTS THAT:
His DD Form 214, Certificate of Release or Discharge from Active
Duty and NGB Form 22, Report of Separation and Record of
Service, be corrected to reflect award of the Meritorious
Service Medal (MSM).

APPLICANT CONTENDS THAT:
He received the MSM after he retired but the citation for the
award did not accompany the medal.

STATEMENT OF FACTS:
According to the applicants military personnel records, on
18 Feb 11, the applicant was relieved from the Air National
Guard (ANG) and transferred to the USAF Reserve Retired List,
effective 13 Mar 11. He was credited with 22 years, 2 months
and 2 days of total service.

AIR FORCE EVALUATION:
ARPC/DPTS recommends denial, indicating that in accordance with
AFI 36-3202, Separation Documents, Table 4, because the
applicant did not complete 90 consecutive days of active duty,
he is not eligible for a DD Form 214 in conjunction with his
retirement. Additionally, there is no MSM awarded so there is
no correction needed to the applicants NGB 22. Furthermore,
the applicant has not provided any source documentation to show
the MSM recommendation was properly submitted to include a
narrative and citation as required nor processed and approved
through his chain of command in the required time limit. Per
AFI 36-2803, The Air Force Military Awards and Decorations
Program, paragraph 2.8.,
Enter each recommendation (except the
Purple Heart) into official channels within 2 years and award
within 3 years of the act, achievement, or service performed.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 10 Feb 15 for review and comment within 30 days.
As of this date, no response has been received by this office
(Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took
notice of the applicants complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
and adopt its rationale as the basis for our conclusion the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find
no basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
